Notice of an amendment to the Code of Florence, Alabama, as amended, and particularly Appendix C of said Code and the official Zoning Map.
Pursuant to instructions given by the City Council of the City of Florence, Alabama, notice is hereby given that the proposed amendment herein below set forth to the Code of Florence, Alabama, as amended, will be considered by the City Council of the City of Florence in the City Hall Auditorium at 5:00 o’clock p.m., on November 19, 2024.
At the said time and place all persons will have the right and are invited to be present and to be heard either for or in opposition to the adoption of said amendment.

ORDINANCE
AN ORDINANCE TO AMEND THE CODE OF FLORENCE, ALABAMA, AS AMENDED, AND PARTICULARLY APPENDIX C OF SAID CODE, AND THE OFFICIAL ZONING MAP.
The Public Welfare Requiring It and under the authority granted by Title 11, Section 11-52-78 of the 1975 Code of Alabama, be it ordained by the City Council of the City of Florence, Alabama, as follows, to-wit:
The Code of Florence, Alabama, as amended, and particularly Appendix C, and the Florence, Alabama, Official Zoning Map as a part thereof is hereby amended, changed and modified to reflect the rezoning of property as follows:
Property is 6.2 +/- acres located at 1018 Hermitage Drive, described as follows,
A parcel of land being a part of the Southwest 1/4 of Section 2, Township 3 South, Range 11 West, city of Florence Lauderdale County, Alabama, and being a part of Lot 2 of the James B. Stewart Jr. Subdivision recorded in plat book 6, page 21, and being more particularly described as follows: Beginning at an iron pin found (1/2” rebar disturbed) locally known and accepted as the Southwest corner of Lot 1, and the Northwest of Lot 2 of the James B. Stewart Jr. Subdivision; thence South 75°50’17” East a distance of
169.83 feet to an iron pin found (capped “P&R CA 00300”) on the current eastern right-of-way of Helton Drive (right of way varies); thence leaving said right of way, South 75°50’17” East a distance of
119.21 feet to a calculated point on the old eastern right of way of Helton Drive (right of way varies); thence South 75°50’17” East a distance of
46.42 feet to a calculated point generally in the center of Helton Drive (right of way varies); thence generally along the center of Helton Drive with a curve turning to the left with an arc length of
689.55 feet, with a radius of
1107.20 feet, with a chord bearing of South 17°22’58” East , with a chord length of
678.46 feet, to a calculated point; thence leaving the center of Helton Drive, South 74°41’21” West a distance of
226.93 feet to a concrete monument found (stamped “AL-DOT”) on the eastern right of way of Helton Drive; thence along said eastern right of way, South 03°58’15” West a distance of
60.98 feet to a concrete monument found (stamped “AL-DOT”); thence continue along said eastern right of way, South 02°57’09” West a distance of
81.46 feet to a concrete monument found (stamped “AL-DOT”); thence continue along said eastern right of way, South 04°17’41” West a distance of
87.78 feet to a concrete monument found (stamped “AL-DOT”) at the intersection of the eastern right of way of Helton Drive and the northern right of way of the Tennessee Railroad Railway (100’ right of way); thence leaving the eastern right of way of Helton Drive and the northern right of way of the Tennessee Railroad Railway (100’ right of way), South 39°54’14” West a distance of
90.50 feet to a calculated point generally in the center of Railroad Avenue (50’ right of way); thence generally along said centerline the following calls; thence with a curve turning to the left with an arc length of
189.13 feet, with a radius of
6375.71 feet, with a chord bearing of North 52°14’13” West , with a chord length of
189.12 feet, to a calculated point; thence North 52°15’47” West a distance of
65.59 feet to a calculated point; thence North 49°53’26” West a distance of
113.05 feet to a calculated point; thence North 48°44’19” West a distance of
220.41 feet to a calculated point; thence North 51°11’44” West a distance of
143.30 feet to a calculated point at the projected intersection of the general centerline of Railroad Avenue and the general centerline of Hermitage Drive; thence leaving said centerline of Railroad Avenue and generally along the center of Hermitage Drive, North 24°33’27” East a distance of
704.82 feet to a calculated point; thence leaving the center of Hermitage Drive, South 65°39’21” East a distance of
39.78 feet to the point of beginning, said tract of land contains an area of
11.90 acres more or less, and is subject to any rights of way, easements, or restrictions affecting said parcel of land.
Said to be rezoned from R-2 (Single Family Residential Small Lot) to R-3 (Multi-Family Residential) as requested by the Estate of James B. Stewart and Andrew J. Spry.
The boundary changes of the above district are hereby established as shown on the Official Zoning Map, made a part of Appendix C of said Code as amended, and as further amended by this ordinance, which map is displayed in the City Planning Department, City Hall, as well as being a part of said Code and all explanatory matter thereon as adopted and made a part of this ordinance.
This ordinance shall go into effect upon its passage and publication as required by law.
