NOTICE OF FORECLOSURE
Default having been made in the payment of the indebtedness secured by that certain mortgage dated January 20, 2000, executed by Willie Joe Johnson and wife, Thelma Odell Johnson, to Associates Financial Services Company of Alabama, Inc., which mortgage was recorded on January 24, 2000, in Book MORT 603, Page 691, and modified by that certain Loan Modification Agreement recorded on March 28, 2025, in Book MORT 880, Page 45, of the mortgage records in the Office of the Judge of Probate of Lawrence County, Alabama and which mortgage was duly transferred and assigned to U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY
AS OWNER TRUSTEE FOR RCF 2 ACQUISITION TRUST, notice is hereby given that pursuant to law and the power of sale contained in said mortgage, the undersigned will sell at public outcry, to the highest bidder for cash, in front of the Main entrance to the Lawrence County Courthouse at Moulton, Alabama during the legal hours of sale on November 13, 2025, the following described real estate, situated in Lawrence County, Alabama, to-wit:
The following described real estate situated in Lawrence County, Alabama to-wit: A tract or parcel of land described as follows, to-wit:
Begin at the NW corner of the East 75 acres of the S 1/2 of the NW 1/4 of Section 28, Township 3 South, Range 8 West, Lawrence County, Alabama, and thence run South a distance of 49 Yards to a point, which point is designated as the true point of beginning of the parcel of land herein described and conveyed and thence from said true point of beginning continue to run South a distance of 49 Yards to a point; thence run East 50 yards to a point; thence run North 49 yards to a point and thence run West 50 yards to the point of beginning and said parcel of land containing one-half (1/2) acre, more or less and being the South 1/2 acre of a 1 acre tract of land as conveyed by deed from Maria Turner, a single woman, to Will Langham by deed dated May 20, 1943 and recorded in Deed Book 30, page 311, Probate Records, Lawrence County, Alabama, and being subject to a right of way for a public road across the West side thereof.
This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as expenses of foreclosure. This property will be sold on an “as is, where is” basis, subject to any easements, encumbrances, and exceptions reflected in the mortgage and those contained in the records of the office of the Judge of Probate of the County where the above-described property is situated. This property will be sold without warranty or recourse, expressed or implied as to condition, title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. The successful bidder must tender full funds at the conclusion of the sale in the form of a certified check made payable or endorsed to Padgett Law Group. No personal checks will be accepted. To this end you must bring sufficient funds to outbid the lender and any other bidders. Insufficient funds will not be accepted. Amounts received in excess of the winning bid will be refunded. Padgett Law Group reserves the right to award the bid to the next highest bidders should the highest bidder fail to timely tender the total amount due.
