NOTICE OF PROPOSED VACATION OF RIGHT OF WAY FOR PUBLIC ROAD
Pursuant to the provisions of Code of Alabama, §§ 23-4-2, 23-4-5, 23-4-20 and 35-2-54 of (1975), and other applicable law, all as last amended, notice is hereby given that:
1. On June 16, 2025, (a) Don P. Gilliam and wife, Sherrie L. Gilliam (6323 Trailwood Drive, Huntsville, Alabama 35811-9415) and (b) Joshua D. Roach and wife, Emily G. Roach (6401 Trailwood Drive, Huntsville, Alabama 35811-9149) (collectively the “Owners”) filed a written Petition for Approval of and Assent to Vacation of, and to Vacate, Right of Way for Public Road (the “Petition”) requesting that the Madison County Commission approve of and assent to the vacation of, and vacate, the Right of Way for Public Road, which is situated and lying and being within Madison County, Alabama but outside the corporate limits of any municipality. The Right of Way for Public Road is more particularly described as:
All that part of Section 34, Township 2 South, Range 1 East of the Huntsville Meridian, being more particularly described as follows: Beginning at a capped rebar set (Stamped Huntsville Land Company Inc. PLS No. 17833) at the Southwest corner of Lot 4 of The Woodlands Second Addition, as recorded in Plat Book 8 Page 93, in the Office of the Judge of Probate, Madison County, Alabama; Thence North 00°45’14” East a distance of
13.58 feet to a point; Thence North 89°58’51” East a distance of
251.87 feet to a point along the West Right-of-Way of Trailwood Drive; Thence along said Right-of-Way, South 00°01’09” West distance of
50.00 feet to a capped rebar found; Thence South 89°58’51” West a distance of
251.87 feet to a point; Thence North 00°45’14” East a distance of
36.42 feet to the Point of Beginning.
2. The date, time, and location of the meeting of the Madison County Commission at which time said proposed vacation is scheduled to be addressed is:

3. Any citizen alleging to be affected by the proposed vacation may submit a written objection to the Madison County Commission or may attend and request an opportunity to be heard at said public hearing.
