FORECLOSURE NOTICE
WHEREAS, on the 25th day of November 2022, LOGAN BROTHERS PROPERTIES, LLC, a Limited Liability Company, did execute and deliver to Bank Independent a mortgage on certain real estate hereinafter described and which mortgage is dated November 25, 2022 and recorded in the Lauderdale County Judge of Probate Office in RLPY 2023, Page 403 et seq; along with an Assignment of Rents dated November 25, 2023 and recorded in the Lauderdale County Judge of Probate Office in RLPY 2023, Page 413 et seq; and
WHEREAS, on the 15th day of May 2023, LOGAN BROTHERS PROPERTES, LLC, a Limited Liability Company, did execute and deliver to Bank Independent a mortgage on certain real estate hereinafter described and which mortgage dated May 15, 2023 and recorded in RLPY 2023, Page 21754 in the Office of the Judge of Probate of Lauderdale County, Alabama; and
WHEREAS, a Modification of Mortgage executed between LOGAN BROTHERS PROPERTIES, LLC, a limited liability company, and Bank Independent, dated August 7, 2023 and recorded in RLPY 2023, Page 2023, Page 47444 in the Office of the Judge of Probate of Lauderdale County, Alabama; and
WHEREAS, default has been made in payment of said mortgages to BANK INDEPENDENT, as provided therein, which default continues at this date, and said mortgage is subject to foreclosure.
NOW, THEREFORE, three weeks notice is hereby given that the undersigned will sell at public outcry to the highest bidder for cash, at the East door of the Lauderdale County Courthouse, Florence, Alabama, within the legal hours of sale, to-wit: 11:00 o’clock A.M. on the 7th day of January, 2025, the real estate described by the said mortgage to BANK INDEPENDENT, being more particularly described as lying and being situated in Lauderdale County, Alabama, to wit:
Lot No. 3, Block 4, WOODLAND TERRACE, according to the plat thereof as recorded in the Office of the Judge of Probate of Lauderdale County, Alabama, in Plat Book 2, Page 142. ALSO KNOWN AS: 416 Lewis Avenue, Florence, AL 35630.
Together with the appurtenances thereunto belonging.
THIS PROPERTY WILL BE SOLD ON AN “AS IS, WHERE IS” BASIS, SUBJECT TO ANY EASEMENTS ENCUMBRANCES, AND EXCEPTIONS REFLECTED IN THE MORTGAGE AND THOSE CONTAINED IN THE RECORDS OF THE OFFICE OF THE JUDGE OF PROBATE OF THE COUNTY WHERE THE ABOVE DESCRIBED PROPERTY IS SITUATED. THIS PROPERTY WILL BE SOLD WITHOUT WARRANTY OR RECOURSE, EXPRESSED OR IMPLIED AS TO TITLE, USE AND/OR ENJOYMENT AND WILL BE SOLD SUBJECT TO THE RIGHT OF REDEMPTION OF ALL PARTIES ENTITLED THERETO.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist, that help persons avoid or delay the foreclosure process. This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure.
The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
Said sale will be made subject to restrictions applying to the subdivision, if any, and to the right of redemption of the parties and for the purpose of foreclosing the mortgages and the costs thereof, and for the payment of any lien superior to that of Bank Independent.
