Take notice that Bill to Quiet Title has been filed by Javier J Martinez against the Fred Horton, Irene Horton, Bobby Joe Horton and/or their devisees, heirs, personal representatives and next of kin if any are deceased, whose addresses are unknown, and against the following described real estate lying and being in Marshall County, Alabama, to-wit:
Commencing at the Southwest corner of the Southeast fourth of the Southeast fourth of Section 26, Township 9 South, Range 3 East of the Huntsville Meridian in Marshall County, Alabama; thence North 4 degrees 00’ West 545 feet; thence South 87 degrees 19’ East 757 feet to the Southwest corner of James M. and Dorothy J. Horton Lot; thence North 8 degrees 55’ East 145 feet; thence South 82 degrees 25’ East 142 feet; thence South 1 degree 42’ East 1.2 feet; thence South 15 degrees 10’ West
114.8 feet; thence South 87 degrees 19’ West 136 feet to the Point of Beginning of said Lot.

Horton and Dorothy Jane Horton lot; thence along the North margin of said James and Dorothy Horton lot North 82 degrees 25’ West 142 feet; thence South 8 degrees 55’ West 145 feet; thence South 87 degrees 49’ West 20 feet to the Point of Beginning; and being part of the Southeast fourth of the Southeast fourth of Section 26, Township 9 South, Range 3 East of the Huntsville Meridian in Marshall County, Alabama. And against any and all persons claiming any title to, interest in, lien or encumbrance on said lands or any part thereof. Said Bill is to establish the right of title to said lands and clear up all disputes concerning the same.
Plaintiff claims title to said land in that he has been in actual, open and notorious possession of said land and paid all ad valorem taxes on said lands for a period of more than 3 years. All persons having any interest in said lands or claiming any title thereto or any encumbrance or lien thereon must answer said Bill on or before January 28, 2024, or a judgment by default may be rendered against them in Case No. CV-2024-900230, in the Circuit Court of Marshall County, Alabama.
